ZES is the only new development in the 2025 Budget Law

Good news is on the way for businesses operating in the ZES with the new 2025 Budget Law.

The 2025 Budget Bill, currently under review by the Budget, Treasury, and Planning Committees of the Chamber of Deputies and Senate, confirms the tax credit for investments in the unique Special Economic Zone (ZES), offering new opportunities for businesses in Southern Italy. The measure includes a new financial allocation of 1.6 billion euros and aims to promote economic development in Southern Italy.

Request Procedure and Communications

The procedure to request the tax credit in the ZES under the new 2025 Budget Law remains unchanged. Economic operators will need to submit an initial communication, followed by a supplementary communication to confirm the completion of the investments. It is crucial that the amounts declared in the supplementary communication do not exceed those indicated in the initial phase to ensure eligibility.

Spending Limits and Tax Credit Calculation

The amount of the tax credit for each beneficiary will be determined by a percentage, calculated in relation to the overall spending limit and the total amount of credits requested. Article 77, paragraph 4, clarifies that “the maximum usable credit will be based on the amount reported in the supplementary communication, as indicated in paragraph 2, and then multiplied by a percentage.” This percentage will be established by a decree from the Director of the Revenue Agency, issued within ten days of the deadline for submitting supplementary communications.

The percentage will be calculated by comparing the overall spending limit with the total credits requested in the communications. If the actual amount of the tax credit is lower than the maximum allowed, regions will be able to use additional funds from European cohesion programs to further strengthen investments. This way, the Revenue Agency will ensure an equitable distribution of the available funds.

Investment Monitoring

To ensure the transparent and efficient use of funds, the Budget Bill (Ddl di Bilancio) has introduced an investment monitoring system. Businesses will be required to report to the Revenue Agency, between March 31 and May 30, 2025, the expenses incurred from November 16, 2024, as well as those expected up until November 15, 2025. This monitoring system ensures more accurate management of incentives.

How to Submit the Application

Requests for the tax credit must be submitted between March 31 and May 30, 2025, with the completion of investments expected by November 15, 2025. Businesses must then submit an integrative communication by December 2, 2025, to certify the investments made.
